Employment Standards in Ontario: Finding Information for Employers

Introduction

Do you own a business in Ontario and plan on hiring employees now or in the future?  If so, you should know that there are many laws that must be followed while managing employees.

In this post, we’re going to introduce you to the Employment Standards section of the Ontario Ministry of Labour’s website and where you can find the laws that you need to know.

Our Findings

To start, you’ll need to go to the Employment Standards section of the Ontario Ministry of Labour’s website.  This section can be found here.

In its current format, if you scroll down to the “Key Resources” section in the body of the webpage, you’ll find links to most of the Employment Standards resources that you will need.  Of the links in this section, the primary ones that you are likely to use on a regular basis are as follows.

The Employment Standards Act

Given that it is the true, written law, the most important page of information within the Employment Standards website is obviously the Employment Standards Act itself.  The entire online version of the Employment Standards Act can be found here.

Guide to the Employment Standards Act

If you’ve ever tried to navigate and read laws such as the one mentioned above, you’d know that it is not always the easiest to find and extract information that you need.  Knowing this, the Ontario Ministry of Labour has made a “Guide to the Employment Standards Act” to help people find the information that they need to know.  This guide can be found here.

If you have a look through this guide, you’ll find the contents of Ontario’s Employment Standards Act broken down into clear, manageable, and understandable sections based on different subjects of interest.  Some section subjects include: Record Keeping, Payment of Wages, Minimum Wage, Hours of Work, Overtime, Vacation, among others.

We highly recommend that you familiarize yourself with this section of the website—it will likely be your primary place of reference for all of your Employment Standards needs.

What Businesses Need to Know

This page of the Employment Standards section explains some of the primary subjects of interest for employers in Ontario.  It acts as a great summation of information for employers that are new to Employment Standards.  It can be found here.

Employment Standards Tools

This page of the Employment Standards section offers some useful tools to help employers follow Employment Standards.  The tools are as follows: Employment Standards Workbook; Hours of Work and Overtime Tool; Public Holiday Pay Calculator; Severance Tool; Special Rule Tool; and Termination Tool.  All of these tools can be found here.

Final Thoughts

Laws are complicated, but they have to be followed.  If you don’t follow the law, you may face lawsuits and extensive fines.  As a result, we highly recommend that you take some time to navigate the entire website and familiarize yourself with the subject, its laws, and all other applicable information.  Altogether, the more time you spend, the easier it will be to understand everything and the less headaches you will have in the long run.
